Terms of service
1. Service
Internet radio stream hosting (Shoutcast v2 or Icecast) with a control panel and AutoDJ, within the limits of the chosen plan: simultaneous listeners, bitrate and disk space.
2. Term and renewal
Plans are monthly, 1-year or 2-year and renew for the same period. On the 1- and 2-year plans payment is made in advance for the whole period. There is no lock-in: you can cancel the renewal through a support request and the service stays active until the end of the paid period.
3. Prices and invoicing
Prices are those shown on the website. On invoices to customers with a Portuguese tax number and address, the activity is VAT-exempt under Art. 53 of the Portuguese VAT Code (CIVA) and invoices state so; for other customers, the VAT treatment required by law applies. Invoices are issued by Sónia Paula Fernandes Minderico Pereira (tax no. 212578936) to customers with a Portuguese tax number and address, and by Ventura Pereira — Contabilidade e Informática, Lda. (SmartSYS) (tax no. 513 349 251) to all others. The 1-year plan equals 11 months of the monthly price (1 month free) and the 2-year plan equals 21 months (3 months free).
4. Right of withdrawal
If you are a consumer, you may withdraw from the contract without giving a reason within 14 days of the date it is concluded (Portuguese Decree-Law 24/2014). Within that period we refund the full amount paid, even if the service is already active, using the same payment method and within 14 days of receiving your notice. To exercise the right, just send a clear statement to suporte@soundflux.eu; you may use the legal model form, but it is not required.
5. Content and rights
The customer is solely responsible for the content they broadcast and for holding the necessary rights and licences, including copyright and related rights. Broadcasting illegal content is prohibited.
6. Use and limits
Plan limits must be respected. Use that harms other customers or the server may be restricted.
7. Availability
We make reasonable efforts to keep the service running, without guaranteeing continuous availability. Maintenance work may occur.
8. Suspension
The service may be suspended for non-payment or breach of these terms, with prior notice where possible.
9. Streaming to external platforms
On the Advanced and Professional plans, the customer may connect the radio to YouTube and Facebook. The customer is solely responsible for the content transmitted, including copyright and related rights in music and other content, and for complying with those platforms’ rules. SoundFlux accepts no responsibility for what is transmitted to those platforms, nor for any restriction, suspension or ban they apply to the customer’s channel or account.
10. Dispute resolution
In a consumer dispute, the consumer may turn to the alternative dispute resolution body CNIACC – Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (arbitragemdeconsumo.org). You may also file a complaint in the Portuguese electronic Complaints Book (livroreclamacoes.pt).
11. Governing law
Portuguese law applies. Contact: suporte@soundflux.eu.
